The U.S. District Court for the Southern District of Texas ruled in Adams EMS, Inc. v. Azar, No. H-18-1443(S.D. Tex. July 11, 2018) that the Centers for Medicare and Medicaid Services (CMS) could not recoup monies until after Administrative Law Judge (ALJ) hearings have been held. The Court issued a temporary restraining order (TRO) prohibiting CMS from recouping an overpayment.[The ALJ’s hearings had been held. In this case, the Court issued a TRO prohibiting cases from recouperating any overpayment. Hogue provided more details about the ZONE PROGRAM and receiving overpayment on claims submitted between July 17, 2010 and Jan. 15, 2016.
Further details are provided on the recoupments and requirements of parties involved with this case and CMS’s involvement in the case and other activities and, as the author concludes the piece about the court’s ruling on recouping of home health agency monies, the focus must be to appeal AJL precedents set in 2010 and 2016.

In its 682 pages, the CMS 2019 home health final rule lays out numerous payment updates, case-mix refinements, and quality reporting changes that will affect home health agencies in 2019 and beyond. It also finalizes the implementation plan for the so-called Patient Driven Groupings Model — a dramatic change in the home health unit of payment from 60 days to 30 days for calendar year 2020. Patrick J. Kennedy represented Rhode Island Congressional District 1 from 1995 to 2011. The youngest son of Senator Ted Kennedy left Congress to devote himself full-time to mental health advocacy following the 2011 passing of his older sister, Kara, which came two years after his father’s death.

A recent Marcus Evans Events Healthcare CXO Summit in Palm Springs, California featured a high-powered lineup of hospital and post-acute care executives, relating stories of the efforts of their organizations to prepare for changes coming to the healthcare industry. But Kennedy stole the show. His frank, autobiographical presentation laid bare a lifetime struggle with, and eventual victory over, substance abuse, followed by an appeal to join his battle.

[Rowan proceeds to track a very wide range of significant bills related to mental health passed by Kenned while in the House of Representatives. “Following the pause of the Pre-Claim Review Demonstration for Home Health Services on April 1, 2017, CMS worked to revise the Demonstration to offer more flexibility and choice for providers, as well as risk-based changes to reward providers who show compliance with Medicare home health policies.  The proposed Review Choice Demonstration for Home Health Services will give providers in the demonstration states an initial choice of three options – pre-claim review, postpayment review, or minimal postpayment review with a 25% payment reduction for all home health services. A provider’s compliance with Medicare billing, coding, and coverage requirements determines the provider’s next steps under the Demonstration. CMS will implement the Demonstration for the Home Health and Hospice Medicare Administrative Contractor Jurisdiction M (Palmetto) providers operating in Illinois, Ohio, North Carolina, Florida, and Texas for five years, with the option to expand to other states in the Palmetto/JM Jurisdiction.
